This is a Constitutional crisis

This is your daily reminder that resistance is necessary if our American Republic is to survive. 

This is a repost from earlier this year (April 18, 2025). Since that time, the crisis has only grown. The US Constitution is under attack. American citizens are being detained. American cities are being occupied. Trump's power grows every day. 

No One is holding him accountable.

When Must We Kill Them?" By Nicholas Decker

There is an article making waves right now, "When Must We Kill Them?" By Nicholas Decker. It is written by a libertarian, a philosophy I do not support. Instead, I support active government services for the benefit and betterment of its citizens, we taxpayers who deserve and demand services for the taxes we pay. That is one reason I am adamantly opposed to the Trump administration's current and ongoing dismantling of the United States government. 

Further, I am a sworn supporter of the Constitution. This means I recognize the legislative branch's power of the purse which is being dismantled by the DOGE (pronounce it Doggy) cuts from Elon and his band of teenage incel hackers. 

I also recognize the power of the Courts in the Constitutional balance of power. Trump's defiance of the courts, the non compliance of due process, the attack on birthright citizenship as unconstitutional, and more, is a violation of the President's oath of office. POTUS has created a Constitutional crisis.

I also recognize the duty of Congress to impeach the President and his staff based on his acts against the Constitution. Further, I view Trump's actions as treasonous at many levels including pardoning those who committed treason against the US on January 6th's attack on the Capital. I also believe that Trump and his cronies have acted against the national security of the United States, violating the laws which govern national security, and are pursing a policy of alliance in the interests of other nations and against the United States. I believe he and members of his cabinet and party are guilty of treason against the United States.

I believe that Trump, his cabinet and appointees, and members of his political party are actively violating the laws of the United States. This includes the failure to preserve documents related to preserving information for the historical record to violating security protocols. They are using the office of the Executive to undermine the other branches of government. They are targeting persons and groups who do not violate federal law, rather those who are perceived as personal enemies of the individual Trump, not the office of the President. I believe that he and his cohorts should be tried and convicted of treason and violating of the laws of the nation. 

It is for these reasons and my support of the First Amendment's protection of Speech that I am posting a copy of Nicolas Decker's opinion piece. I also believe that it is a message which must be preserved, not cancelled, not forced to be removed, and most certainly not retracted. While I do not agree with everything written within, stated or implied, or misread, I believe his is but one call in these early days of resistance to the Trump administration's attack on the United States Constitution with its actions which undermine the position and authority of the nation on the global stage, and its attack on Democracy itself, and its attempts to dismantle the US Constitution.

Edit 04/18/2025: Well didn’t that get quite a reception! The response has been far greater than I anticipated; I was certainly impressed by the inventiveness and facility of my interlocutors. I wish to make a few points clear. Violence is a last resort, not a first resort. It must come after the exhaustion of all possible remedy. It is not, moreover, appropriate for decisions which are merely unwise or disastrous. It is to be employed only in defense of our Constitution, and of democracy. If it is resorted to, it must be narrowly targeted, and aimed only at extirpating those who have power, and are unjustly resisting giving it up.


Evil has come to America. The present administration is engaged in barbarism; it has arbitrarily imprisoned its opponents, revoked the visas of thousands of students, imposed taxes upon us without our consent, and seeks to destroy the institutions which oppose it. Its leader has threatened those who produce unfavorable coverage, and suggested that their licenses be revoked. It has deprived us, in many cases, of trial by jury; it has subjected us to a jurisdiction foreign to our constitution, and has transported us beyond seas to be imprisoned for pretended offenses. It has scorned the orders of our courts, and threatens to alter fundamentally our form of government. It has pardoned its thugs, and extorted the lawyers who defended its opponents.*

If these actions become normal, the government could arrest anyone and deport them to prison in a foreign land, without hope of redress, for no reason. It is nothing less than the total abdication of rule of law in this country. There is no guard or protection against it. If this theory prevails, then it is the end of America as a free nation.

I do not wish for this essay to be a mere catalogue of outrages. The conduct of the present administration is as well known to you as it is to myself, and can be understood by any sensible person. On it, no further comment is ventured.

What remains for us to decide is when we fight. If the present administration wills it, it could sweep away the courts, it could sweep away democracy, and it could sweep away freedom.** Protest is useful only insofar as it can effect action. Our words might sway the hearts of men, but not of beasts.

If the present administration chooses this course, then the questions of the day can be settled not with legislation, but with blood and iron. In short, we must decide when we must kill them. None of us wish for war, but if the present administration wishes to destroy the nation I would accept war rather than see it perish. I hope that you would choose the same.***

But what to do? The rot of the present administration runs deeper than one man. The sacrifice of a hero is insufficient to save our nation, and a gust of wind on a summer day would not have saved us. For let us make no mistake; the problem is not one man, but a whole class of people. If one head is cut off, another would take its place.****

Violence only makes sense as part of coordinated strategy. This is why protests are important – not as a way of changing the present administration’s actions, but as a way to coordinate a group. There may come a time when we shall have no guarantee of freedom but the one which we make for ourselves. If it comes, I tell you that there is no greater honor than he who lays down his life for his friends. Until then, we must wait.

And when is that time? Your threshold may differ from mine, but you must have one. If the present administration should cancel elections; if it should engage in fraud in the electoral process; if it should suppress the speech of its opponents, and jail its political adversaries; if it ignores the will of Congress; if it should directly spurn the orders of the court; all these are reasons for revolution. It may be best to stave off, and wait for elections to throw out this scourge; but if it should threaten the ability to remove it, we shall have no choice. We will have to do the right thing. We will have to prepare ourselves to die. I hope that we should conduct ourselves with such courage that it will be our finest hour; I expect that we shall do our duty.

While we wait, we must not be like sheep to the slaughter. We cannot cooperate. We must hide those who are persecuted; we must foil the aims of their agents. The state and local governments which we control can litigate the actions of the present administration. Their police can refuse to share information or be deputized to do the work of the evil ones. If war is politics by other means, then politics is war by other means. There can be no surrender, for surrender means the oppression of all of us.

These are exceptional times! We have not faced such a threat in many years. I wish that it had not come. It is the sorrow of the world that these times have come, and it is we who shall have to bring woe unto those through whom it came.

The future is not certain. It may be that the present administration should flinch, and turn back in face of lighter action. I fondly hope that that may be the case. But if it comes, we must awaken from this ignorant dream. This evil will not pass without blood, sweat, toil, and tears. So harden your hearts, and be prepared to die.*****

Personal Notes: 
* The first paragraph expresses echoes of The Declaration Of Independence which rightly called out the wrongs against the American colonists by a man who was king and not merely wished himself to be.

**This has begun. We are in a Constitutional crisis. The President is defying the Courts. The President has taken away the power of the purse given to Congress. The right to due process has been taken away in executive action taken by the Executive branch and enacted by his party through The Laken Riley Act. The President has fired personnel against the laws established.

***We have treason laws which must be considered for the acts of this administration. However, the executive branch has installed puppets which do not limit and contain his acts to lawful actions with legal oversight as intended. These puppets allow the President to act illegally. The President has acted in direct violation of his oath of office and pursued policies that are against the United States security, protection, and preservation of the US Constitution. 

****Trump's enablers must be held accountable under the law that they violate. The question is how do we remove them from power, try them for their illegal actions, and weigh treason charges against them in the current political situation when the Courts are being defied and the party of Trump does not hold him in check as the US Constitution requires.

*****Make no mistake: the actions of Trump and his ilk are EVIL and they seek to undermine and undo these United States of America.
